Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the OmniPet mobile application, website, and related services (together, the “Services”) provided by OmniPet LLC (“OmniPet,” “we,” “us,” or “our”). Please read them carefully. By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Content in the Services is for informational and educational purposes only and is not a substitute for professional veterinary diagnosis, advice, or treatment. Always consult a licensed veterinarian regarding your pet’s health, and seek emergency care when needed. Never disregard or delay professional advice because of something you read in the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Services. By using the Services, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Your account

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@omnipet.app of any unauthorized use or security breach. We may suspend or terminate accounts that violate these Terms.

3. License to use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Services for your personal, non-commercial use. This license does not include any right to resell, distribute, or create derivative works, except as expressly permitted by us in writing.

4. Acceptable use

You agree not to, and not to permit others to:

  • Use the Services for any unlawful, harmful, or fraudulent purpose;
  • Violate the intellectual property or other rights of any person;
  • Upload or transmit malware, or attempt to gain unauthorized access to the Services or related systems;
  • Interfere with, disrupt, or place undue load on the Services;
  • Reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
  • Scrape, harvest, or collect data from the Services without our permission;
  • Impersonate any person or misrepresent your affiliation; or
  • Post content that is unlawful, defamatory, obscene, harassing, or otherwise objectionable.

5. User content

The Services may allow you to submit content, including pet profiles, photos, and other materials (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), and display it solely to operate, provide, and improve the Services. You represent that you have the rights necessary to grant this license and that your User Content does not violate these Terms or any law. We may remove User Content that we believe violates these Terms.

6. Intellectual property

The Services, including all software, text, graphics, logos, and other content we provide (excluding User Content), are owned by OmniPet or our licensors and are protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you. “OmniPet” and our logos are our trademarks and may not be used without our prior written consent.

7. Purchases, subscriptions, and payments

Certain features may be offered for a fee or as part of a subscription. Prices and features are described at the point of purchase. Purchases and subscriptions made through a mobile app store are processed by that store and are also subject to its terms. Unless otherwise stated or required by law:

  • Subscriptions renew automatically for the applicable period until canceled;
  • You may manage or cancel a subscription through your app store account settings; and
  • Fees are non-refundable except where required by applicable law or store policy.

8. Third-party services and content

The Services may integrate with or link to third-party products, services, or content that we do not control. We are not responsible for third-party offerings, and your use of them is governed by their terms and policies. References to third parties do not imply endorsement.

9. Informational and health disclaimer

OmniPet is not a veterinary provider and does not provide medical or veterinary services. Any tools, reminders, recommendations, or content in the Services are general in nature and may not apply to your pet’s specific situation. You are solely responsible for decisions about your pet’s care. In an emergency, contact a licensed veterinarian or an animal poison control service immediately.

10. Disclaimers of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNIPET AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless OmniPet and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or any law.

13. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or other users. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

14. Governing law and dispute resolution

These Terms are governed by the laws of Arizona, USA, without regard to its conflict-of-laws rules. Subject to any mandatory rights you have as a consumer, you agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the courts located in Maricopa County, AZ, and you consent to their jurisdiction.

15. Changes to the Services or these Terms

We may modify or discontinue the Services, in whole or in part, at any time. We may also update these Terms from time to time. If we make material changes, we will provide notice as required by law, for example by posting the updated Terms with a new effective date or through in-app notice. Your continued use of the Services after an update means you accept the revised Terms.

16. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OmniPet regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
